1. About these terms

These terms of use (Terms) govern your access to and use of the website at https://www.investmentfinder.app and any related pages, data and services (together, the Site). The Site is operated by Investment Finder (we, us, our), based in Australia.

By accessing or using the Site you agree to be bound by these Terms and by our Privacy policy. If you do not agree, do not use the Site. We may update these Terms from time to time by publishing a revised version on this page; continued use after a change means you accept the revised Terms.

2. General information only, not financial advice

Everything on the Site is general information only. It has been prepared without taking into account your objectives, financial situation or needs. Nothing on the Site is, or should be taken as, personal financial advice, a recommendation, an offer, or an invitation to buy, sell or hold any financial product.

We do not hold an Australian Financial Services Licence and we are not a financial adviser, broker, fund manager or product issuer. Before making any investment decision you should consider whether the information is appropriate for your circumstances, read the relevant Product Disclosure Statement and Target Market Determination issued by the product issuer, and consider obtaining advice from a licensed financial adviser.

Lists of funds on the Site are the result of filters, sorts and calculations you choose. They are not a recommendation of any fund, and the order in which funds appear does not imply that one is better than another.

3. Data, accuracy and past performance

The figures on the Site are statistics we derive from third-party data, including end-of-day market data, the ASX Investment Products monthly report and holdings files published by fund issuers. Those sources may be incomplete, delayed, revised or wrong, and our calculations may contain errors. We do not verify issuer data.

• Returns are total returns with distributions reinvested and exclude franking credits, tax, brokerage and other costs. They will differ from the returns an actual investor received.
• Figures reported by the ASX or an issuer may be calculated on a different basis and may not match ours.
• Holdings, exposures and overlap figures reflect the most recent issuer file we processed, which may be weeks or months old, and depend on how we match securities across issuers.
• Data is updated periodically, not in real time. The Site does not display live or delayed prices or quotes.

Past performance is not a reliable indicator of future performance. The value of investments and the income from them can go down as well as up.

4. Accounts

Some features, such as comparing funds and searching company holdings, require a free account. You must give accurate information when you register, keep your password secure, and tell us if you suspect unauthorised use of your account. You are responsible for activity under your account. You may sign in with a Google or Facebook account instead of a password; those providers' own terms apply to your use of them. We may suspend or close accounts that breach these Terms, and we may withdraw or change the features available to free accounts at any time. You can close your account by emailing us.

5. Permitted use

You may use the Site for your own personal, non-commercial information purposes. You must not:

• scrape, crawl, harvest or bulk-download data from the Site, or access it by automated means other than a search engine indexing pages in accordance with our robots.txt file;
• copy, republish, redistribute, sell, licence or commercially exploit the Site or its data, in whole or in part, without our written permission;
• use the Site in a way that could damage, overload or impair it, or interfere with anyone else's use of it;
• attempt to gain unauthorised access to the Site, its servers or any connected database;
• remove or obscure any notice of ownership, or present the Site's data as your own or as an official source; or
• use the Site for any unlawful purpose or in breach of any applicable law.

We may block, suspend or limit access to the Site, or to any user, at any time and without notice.

6. Intellectual property

The Site, including its design, text, graphics, code, and the compilations and derived statistics we produce, is owned by or licensed to us and is protected by copyright and other intellectual property laws. Fund names, issuer names, tickers and trade marks belong to their respective owners and are used only to identify the products concerned; no affiliation with or endorsement by any issuer or exchange is implied.

7. Third-party sites and affiliate links

The Site may link to third-party websites, such as issuer product pages and disclosure documents. We do not control those sites and are not responsible for their content, accuracy or privacy practices. Some links may be affiliate or referral links, meaning we may receive a payment if you click them or take up a product or service. This does not influence the data or calculations on the Site, and it is not a recommendation.

8. No warranties

To the maximum extent permitted by law, the Site and all information on it are provided “as is” and “as available” without any warranty of any kind, whether express, implied or statutory, including any warranty of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure or free of viruses or other harmful components.

9. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010(Cth), including the Australian Consumer Law, or any other law that cannot lawfully be excluded, restricted or modified.

Subject to that, and to the maximum extent permitted by law:

• we exclude all liability to you or anyone else, whether in contract, tort (including negligence), under statute or otherwise, for any loss, damage, cost or expense arising out of or in connection with the Site, its content or its data, or your use of or reliance on them;
• without limiting the above, we are not liable for any investment loss, loss of profits, loss of income, loss of data, or any indirect, incidental, special or consequential loss, even if we were advised of the possibility of that loss; and
• where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant services or paying the cost of having them re-supplied, and in any case to a total of A$100.

You acknowledge that you use the Site and make any investment decision entirely at your own risk, and that you are responsible for verifying any information before relying on it.

10. Indemnity

You indemnify us against any claim, loss, damage, cost or expense (including reasonable legal costs) arising from your breach of these Terms or your misuse of the Site.

11. Changes and availability

We may change, suspend or discontinue any part of the Site at any time without notice, including the data sources we use, the statistics we publish and the funds we cover. We are under no obligation to keep the Site available or to update any information.

12. Governing law

These Terms are governed by the laws in force in Australia. You submit to the non-exclusive jurisdiction of the courts of Australia and any courts that may hear appeals from them. If any part of these Terms is invalid or unenforceable, that part is severed and the rest continues in force.
